ḤADĪTH OF THE DAY

“ The Messenger of God, peace and blessings of God be upon him, said, "Whoever intentionally kills a believer is to be handed over to the inheritors of the murder victim. If they want, they may have him (1) put to death; or if they want, they may take the blood money, which is: thirty four-year-old camels, thirty five-year-old camels, and forty pregnant camels. And they have the right to whatever conciliation they agree upon (2)." Footnotes: (1)Masculine pronouns are generally used in Arabic as a means for referring to both men and women when the meaning is left general and is not otherwise specified. (2) This is an indication that to settle the issue, they may ask for other things apart from the blood money or accept a reduced amount thereof. ”

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى الْعَدَنِىُّ الْمَكِّىُّ- وَيُكْنَى بِأَبِى عَبْدِ اللَّهِ الرَّجُلُ الصَّالِحُ هُوَ ابْنُ أَبِى عُمَرَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَبْدِ الْمَلِكِ بْنِ نَوْفَلِ بْنِ مُسَاحِقٍ عَنِ ابْنِ عِصَامٍ الْمُزَنِىِّ عَنْ أَبِيهِ وَكَانَتْ لَهُ صُحْبَةٌ قَالَ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم إِذَا بَعَثَ جَيْشًا أَوْ سَرِيَّةً يَقُولُ لَهُمْ إِذَا رَأَيْتُمْ مَسْجِدًا أَوْ سَمِعْتُمْ مُؤَذِّنًا فَلاَ تَقْتُلُوا أَحَدًا. قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ وَهُوَ حَدِيثُ ابْنِ عُيَيْنَةَ.

Whenever the Messenger of God, peace and blessings of God be upon him, dispatched an army or a brigade, he would tell them, "If you see a mosque or hear the call to prayer (1) do not kill anyone." Footnote: 1. A mosque and the Islamic call to prayer assumes the presence of Muslims among the people they were sent out to encounter (whether on patrol or for defense).
